Terms of Passage

1. Parties

These Terms of Passage (“Terms”) are entered into between the guest (“you”, “the guest”) and Yohak-Bespoke Booking Services, a sole proprietorship registered with the Department of Trade and Industry of the Philippines (DTI Business Name Registration No. 8051774, MIMAROPA Region, valid 21 March 2026 – 21 March 2031), owned and operated by Jovet Cabunalda Rosento, trading as “Yohak El Nido” with principal place of business at Villa Centro, Brgy. Villa Libertad, El Nido, Palawan, Philippines (“Yohak”, “we”, “us”, “our”).

By securing a charter, expedition, or any service offered through yohak.ph, you acknowledge that you have read, understood, and agreed to these Terms.

2. The Charter

We provide private boat charters and bespoke marine expeditions in El Nido, Palawan, Philippines. The specific vessel, route, duration, inclusions, and crew are set out in your individual booking confirmation. We reserve the right to substitute vessels, captains, or routes of equivalent or better standard when operationally necessary, with prior notice to you whenever possible.

3. Bookings and Confirmation

A booking is confirmed only when:

  • We have received your full payment or the deposit specified in your booking confirmation

  • You have received a written confirmation from us by email

  • You have agreed to these Terms and our Privacy Policy

Quoted prices are in Philippine Pesos (PHP) unless otherwise stated, and include all taxes lawfully applicable at the time of booking. Fuel surcharges, environmental fees, and statutory port fees may be itemized separately.

4. Payment

Payment is processed through PayPal. We accept PayPal balance, debit cards, and credit cards via PayPal’s secure checkout. We do not see, store, or process your card data ourselves.

For most charters:

  • A deposit is due at the time of booking

  • The balance is due in accordance with the schedule shown in your booking confirmation

5. Cancellation and Refunds

Our cancellation policy is set out in detail in our Refund and Cancellation Policy. In summary:

  • 14 or more days before departure — full refund less a 10% administration fee

  • 7 to 13 days before departure — 50% refund

  • Fewer than 7 days before departure — no refund

We may cancel or reschedule a charter at our discretion when conditions at sea, weather, or vessel safety require it. In such cases you will receive either a full refund of amounts paid or, at your election, a rescheduled date at no additional cost.

6. Force Majeure

Neither party is liable for failure to perform when prevented by events beyond reasonable control, including but not limited to typhoons, severe weather, sea conditions, port closures, government orders, civil unrest, pandemic-related restrictions, or acts of God. In such cases we will offer you a full refund or a rescheduled date at no additional cost.

7. Safety and Conduct

Your safety, and the safety of our crew and other guests, is paramount.

  • Life vests are provided and must be worn when instructed by the captain or crew

  • The captain has final authority on all matters of navigation, weather, and safety, and may abbreviate, alter, or terminate any charter for safety reasons

  • Use of illegal drugs on board is strictly prohibited and will result in immediate termination of the charter without refund

  • Guests under the influence of alcohol may be refused boarding at the captain’s discretion

  • Damage to the vessel or its equipment caused by guest negligence may be charged to the guest

8. Health and Fitness

Marine charters involve inherent risks. By booking, you confirm that you and every member of your party are in reasonable health and fit to participate in marine activities. You must disclose at the time of booking any medical condition, allergy, mobility limitation, or pregnancy that may affect participation. We may, in good faith and at our discretion, decline to take any guest on a charter where doing so would, in our judgment, present an unreasonable risk.

9. Children

Guests under 18 must be accompanied by a parent or legal guardian. Children under 5 must wear a life vest at all times while on board.

10. Travel Insurance

We strongly recommend that every guest secure comprehensive travel insurance covering medical evacuation, trip cancellation, lost baggage, and water-related activities. We are not responsible for losses arising from a guest’s failure to secure appropriate insurance.

11. Photography and Media

We respect your privacy and do not capture, share, or publish images of guests, vessels, or charters on social media or in marketing materials without your explicit, written authorization. See our Privacy Policy for full details.

You may photograph and film your own experience freely. We ask only that you respect the privacy of other guests, our crew, and the local communities we visit.

12. Environmental Stewardship

El Nido is a protected area. By chartering with us, you agree to:

  • Not touch, stand on, or take coral, shells, sand, or marine life

  • Not feed, chase, or harass wildlife

  • Carry out all waste, including biodegradable items, from beaches and islands

  • Comply with all instructions from El Nido Tourism Office, Coast Guard, and our crew

Environmental fees imposed by the El Nido LGU or by the Department of Environment and Natural Resources are itemized in your booking and remitted to the relevant authority.

13. Liability

To the maximum extent permitted by Philippine law, our aggregate liability for any claim arising from or in connection with a charter is limited to the amount actually paid by you for that charter. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for any liability that cannot lawfully be excluded.

We are not liable for:

  • Loss, theft, or damage to personal belongings on board

  • Delays or alterations caused by weather, sea conditions, or force majeure

  • Acts or omissions of independent third-party suppliers (hotels, transfers, restaurants) recommended or arranged at your request

14. Intellectual Property

All content on yohak.ph — including text, photographs, video, the Yohak name, logos, and design — is the intellectual property of Yohak-Bespoke Booking Services or its licensors and is protected by Philippine and international copyright law. You may not reproduce, distribute, or use our content commercially without prior written consent.

15. Privacy

Your personal information is processed in accordance with our Privacy Policy, which forms part of these Terms. We comply with the Philippine Data Privacy Act of 2012 (RA 10173) and, where applicable, the GDPR, UK GDPR, and CCPA.

16. Communication

Operational communications regarding your charter — booking confirmations, day-of-trip coordination, weather updates, and similar — will be sent by email to the address you provide and by WhatsApp to the number you provide. We will never request passwords, payment credentials, or one-time codes by email, WhatsApp, or phone.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the proper courts of Palawan, Philippines.

For guests visiting from the European Economic Area, the United Kingdom, or other jurisdictions, nothing in this clause limits any non-waivable consumer right you may have under the law of your home country.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. The version in effect on the date you confirm your booking is the version that governs your charter.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.
